住建部發文:取消建筑施工勞務資質審批,設立專業作業企業資質

針對建筑工人存在流動性大、老齡化嚴重、技能素質低、合法權益得不到有效保障等問題,住建部之前出臺“關于培育新時期建筑產業工人隊伍的指導意見”,明確提出取消建筑施工勞務資質審批等多項要點:

1、逐步建立施工承包企業自有建筑工人為骨干,專業作業企業自有建筑工人為主體的多元化用工方式。

2取消(xiao)建筑施工(gong)勞務(wu)資質審批,設立專業(ye)(ye)(ye)作業(ye)(ye)(ye)企業(ye)(ye)(ye)資質,實行告知備案制。

3、放寬市場準入限制,鼓勵有一定組織、管理能力的勞務企業通過引進人才、設備等途徑向總承包和專業企業轉型。

4施工總承包企業要建立建筑工人實名制管理制度,明確管理職責,對進入施工現場建筑工人實行實名制管理,記錄建筑工人的身份信息、培訓情況、職業技能、從業記錄等信息。

5、建立行業、企業、院校、社會力量共同參與的建筑工人職業教育培訓體系。創新考培模式,技能鑒定機構應充分依托大中型項目開展技能鑒定。

6、加強對現場作業人員的技能水平和配備比例監督檢查,要將相關情況與市場準入、招標投標、誠信體系、評價評優等掛鉤。

7、推行工程款支付擔保制度,建設單位要求承包單位提供履約保證金的,應向施工承包企業提供相應的支付擔保,采用經濟手段解決工程款支付不及時導致拖欠建筑工人工資問題。

8、施工總承包企業要將勞動合同信息納入實名制管理,嚴禁用勞務分包合同代替勞動合同,杜絕代簽合同。到2020年基本實現勞動合同全覆蓋。

9、建立健全與建筑業相適應的社會保險參保繳費方式,施工企業(包括專業作業企業)應在勞動合同的薪酬中列明用于建筑工人參保所需費用,依法為建筑工人繳納社會保險。

10、根據建筑業特點和實際制定五年和十年支持建筑業工人培訓專項資金中長期規劃。企業(ye)應當在(zai)工(gong)(gong)程造(zao)價(jia)中明確(que)相關費用(yong)用(yong)于工(gong)(gong)人技能培訓。 


已明確取消勞務資質的省市:

  • 2018年11月13日,黑龍江省住建(jian)(jian)廳下(xia)發通知,在全(quan)省(sheng)范(fan)圍內的(de)房(fang)屋建(jian)(jian)筑(zhu)和(he)市政工程建(jian)(jian)設活動中(zhong),取消對施工勞務企業的(de)資質(zhi)要求。

  • 2018年6月(yue)4日,江蘇省住(zhu)建廳下發(fa)通知(zhi),正式取消勞(lao)務資質。

  • 2018年1月1日起,山東省正式取消勞務資質。

  • 2016年8月1日起,西安市取消建筑施工勞務資質。

  • 2016年6月1日起,安徽省取消建筑勞務企業資質。

  • 2016年起,浙江省逐步取消建筑勞務企業資質。

  • 2016年5月6日起,陜西省停止辦理新申請勞務資質審批。

    安徽和山東已經告訴我們具體怎么操作:

    1、安徽   建立“三項”制度清單

    建(jian)立勞(lao)動(dong)合同管理制(zhi)度,用(yong)工(gong)企業(ye)與(yu)作(zuo)業(ye)人(ren)員(yuan)簽訂勞(lao)動(dong)合同,繳(jiao)納(na)各類保險(xian)。建(jian)立實名制(zhi)管理制(zhi)度,實行(xing)建(jian)筑作(zuo)業(ye)人(ren)員(yuan)實名制(zhi)管理。建(jian)立培訓上崗制(zhi)度,堅持“先培訓,后上崗”。


    明晰“三方”用工關系。厘清建筑施工總承包(專業承包)企業建筑勞務(專業作業)企業和作業人員三者之間的關系,明確三方責任。

    • 施工總(zong)承包(專(zhuan)(zhuan)業(ye)承包)企(qi)業(ye)對所承包項(xiang)目的建(jian)筑專(zhuan)(zhuan)業(ye)作業(ye)活動負總(zong)責。

    • 建(jian)筑勞(lao)務(wu)(專業(ye)作(zuo)業(ye))企業(ye)對本企業(ye)的用工行為負直接責任,按月公(gong)示工資支(zhi)付清單。

    • 施工總承包(專(zhuan)業承包)企業對專(zhuan)業作業人(ren)員工資支(zhi)付(fu)情(qing)況負(fu)監督責任,對建筑勞務(wu)(專(zhuan)業作業)企業未按時間節點支(zhi)付(fu)工資的行為負(fu)連帶責任。


    2、山東   將采取多種靈活建筑勞務用工方式

    • 賦予建筑業企業更多用工選擇權,從事房屋建筑和市政工程的工程總承包、施工總承包和專業承包企業,自主選擇具備相應作業能力和從業資格的勞務隊伍或建筑工人。既可以與勞務企業、專業作業企業簽訂勞務合同,也可以直接與勞務人員簽訂勞動合同,確立勞動關系。

    • 賦予建筑工人更多務工自主權,建筑工人自主選擇用工企業,既可以與勞務企業、專業作業企業簽訂勞動合同,也可以直接與工程總承包、施工總承包、專業承包企業簽訂勞動合同。

    • 引導施工總承(cheng)包、專業承(cheng)包企業保(bao)有一定數量的(de)與(yu)其建(jian)立穩定勞(lao)動(dong)關系的(de)骨干(gan)技(ji)術工人隊伍。


    明晰“三方”用工關系。按照“總承包負總責”“誰用工誰負責”的原則

    • 總承包企業(包括工程總承包、施工總承包和直接承包建設單位發包工程的專業承包企業)對所承包項目的建筑作業活動負總責,并依法承擔全部用工責任;

    • 直接與建筑工人確立勞動關系的企業(包括總承包企業、建筑勞務、專業作業企業)對本企業的用工行為負直接責任。

    • 總承包企業對建筑工人工資支付情況負監督責任對直接與建筑工人確立勞(lao)動關系(xi)的企業未按月足額支付工資行為負連帶責任。

    建筑(zhu)(zhu)產業(ye)工(gong)(gong)人(ren)(以(yi)下簡稱(cheng)建筑(zhu)(zhu)工(gong)(gong)人(ren))是建筑(zhu)(zhu)業(ye)發展的基礎,為(wei)(wei)新(xin)型城鎮化建設和(he)國(guo)民經濟快速發展作出了重要(yao)貢獻。當前,建筑(zhu)(zhu)工(gong)(gong)人(ren)存(cun)在流動性大、老齡(ling)化嚴重、技能素(su)質低、合法權益得不到有效保障等問(wen)題,嚴重制約了建筑(zhu)(zhu)業(ye)的持續健康(kang)發展。為(wei)(wei)貫徹落實《新(xin)時期(qi)產業(ye)工(gong)(gong)人(ren)隊伍建設改(gai)革方案》《國(guo)務(wu)院辦公(gong)廳關于(yu)促(cu)進(jin)建筑(zhu)(zhu)業(ye)持續健康(kang)發展的意(yi)見》和(he)《國(guo)務(wu)院辦公(gong)廳關于(yu)全(quan)面(mian)治(zhi)理拖欠農(nong)民工(gong)(gong)工(gong)(gong)資問(wen)題的意(yi)見》,加快培(pei)育新(xin)時期(qi)建筑(zhu)(zhu)工(gong)(gong)人(ren)隊伍,現提(ti)出以(yi)下意(yi)見:


    一、總體要求


    (一)指導思想

    全面(mian)貫徹黨的十九大(da)精神,以(yi)習近平新時代中國特色(se)社會主(zhu)義思想為指導,認真落(luo)實黨中央、國務院(yuan)決(jue)策部署,統籌推進“五位一體”總體布局和(he)協(xie)調(diao)推進“四個全面(mian)”戰略布局,牢(lao)固樹立和(he)貫徹落(luo)實創新、協(xie)調(diao)、綠色(se)、開放、共享(xiang)的發(fa)展(zhan)理念,以(yi)推進供(gong)給側結構(gou)性改革為主(zhu)線,破(po)除不適應建筑工(gong)人(ren)隊伍建設要求的體制機制障礙,充分(fen)調(diao)動企業和(he)廣大(da)建筑工(gong)人(ren)的積極性,為建筑業持(chi)續健康(kang)發(fa)展(zhan)和(he)實現新型城鎮化提供(gong)有力支撐。


    (二)基本原則

    堅持政(zheng)府引導,企業主(zhu)(zhu)導。強化政(zheng)策(ce)指導,加大財政(zheng)投入,強化監督管理,依法有序(xu)培育建(jian)筑工人隊伍;充分發揮(hui)企業在建(jian)筑工人組織(zhi)化、技能培訓等(deng)方面的主(zhu)(zhu)體(ti)作(zuo)用,落實保(bao)障(zhang)建(jian)筑工人合法權益的主(zhu)(zhu)體(ti)責任。


    堅持以人為本,創(chuang)新發展。健全預(yu)防和解(jie)決拖欠農(nong)民工(gong)工(gong)資問題的長效機制(zhi),探索適合建筑業特(te)點(dian)的社會(hui)保險繳納機制(zhi),切實(shi)保障農(nong)民工(gong)勞(lao)動報酬權益,加大(da)技能培訓力(li)度,不斷提升建筑工(gong)人的技能水(shui)平。


    堅(jian)持因地制宜,穩步推進(jin)。立足建筑(zhu)業(ye)(ye)行業(ye)(ye)和(he)地區發展(zhan)(zhan)實(shi)際,深入(ru)分(fen)析當前問題產生的深層次(ci)原因,堅(jian)持標本兼治,試點(dian)先行,樣板引路,穩步推進(jin)各項改革,打通(tong)建筑(zhu)工(gong)人職業(ye)(ye)發展(zhan)(zhan)通(tong)道。


    (三)目標任務

    深化建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)用工(gong)(gong)(gong)制度改革,建(jian)(jian)立建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)職業(ye)化發展(zhan)道(dao)路,推動(dong)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)農(nong)民工(gong)(gong)(gong)向建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)轉變,健(jian)全建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)技(ji)能(neng)培訓(xun)、技(ji)能(neng)鑒定體系,到2025年,建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)技(ji)能(neng)素質大(da)幅提升,中級(ji)工(gong)(gong)(gong)以上建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)達到1000萬,建(jian)(jian)立保(bao)護建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)人(ren)(ren)(ren)合法權益的長(chang)效(xiao)機(ji)制,打(da)通技(ji)能(neng)人(ren)(ren)(ren)才職業(ye)發展(zhan)通道(dao),弘揚(yang)勞模精神和工(gong)(gong)(gong)匠精神,建(jian)(jian)設一支知識型、技(ji)能(neng)型、創(chuang)新型的建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)產業(ye)工(gong)(gong)(gong)人(ren)(ren)(ren)大(da)軍。


    二、深化勞務用工制度改革


    (一(yi))構建(jian)(jian)新型建(jian)(jian)筑用工(gong)體系(xi)。逐步建(jian)(jian)立施工(gong)承(cheng)(cheng)包(bao)企業自有(you)(you)建(jian)(jian)筑工(gong)人(ren)(ren)為(wei)骨(gu)干,專業作(zuo)(zuo)(zuo)業企業自有(you)(you)建(jian)(jian)筑工(gong)人(ren)(ren)為(wei)主(zhu)體的(de)多元(yuan)化用工(gong)方式。鼓勵(li)施工(gong)總(zong)承(cheng)(cheng)包(bao)、專業承(cheng)(cheng)包(bao)企業培育以特(te)種作(zuo)(zuo)(zuo)業工(gong)種、高技(ji)能(neng)建(jian)(jian)筑工(gong)人(ren)(ren)為(wei)主(zhu)的(de)自有(you)(you)建(jian)(jian)筑工(gong)人(ren)(ren)隊伍,作(zuo)(zuo)(zuo)為(wei)技(ji)術骨(gu)干承(cheng)(cheng)擔施工(gong)現場作(zuo)(zuo)(zuo)業帶班或監督等(deng)工(gong)作(zuo)(zuo)(zuo)。專業作(zuo)(zuo)(zuo)業企業應當與(yu)建(jian)(jian)筑工(gong)人(ren)(ren)建(jian)(jian)立相對(dui)穩定的(de)勞(lao)動(dong)關系(xi),依(yi)法簽(qian)訂勞(lao)動(dong)合(he)同(tong)。


    (二)大(da)力發展專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)。加大(da)政策扶(fu)持(chi)力度,深入推(tui)進“大(da)眾(zhong)創新、萬眾(zhong)創業(ye)(ye)(ye)(ye)(ye)”,充(chong)分(fen)依托各地“雙創基地”,鼓勵和引導現有勞務(wu)(wu)班組或有一定(ding)技能和經(jing)驗的班組長成立以作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)為主(zhu)的專(zhuan)業(ye)(ye)(ye)(ye)(ye)公司或注冊個體(ti)(ti)工(gong)商戶,作(zuo)(zuo)為建(jian)(jian)筑(zhu)工(gong)人的合法載體(ti)(ti),促進建(jian)(jian)筑(zhu)業(ye)(ye)(ye)(ye)(ye)農民工(gong)向技術工(gong)人轉(zhuan)型,提高建(jian)(jian)筑(zhu)工(gong)人的歸屬(shu)感。取消建(jian)(jian)筑(zhu)施(shi)工(gong)勞務(wu)(wu)資質審(shen)批,設立專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)資質,實行告知備(bei)案制(zhi)。專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)取得工(gong)商登記后,應(ying)到縣(xian)級住(zhu)房(fang)城鄉(xiang)建(jian)(jian)設主(zhu)管部(bu)(bu)門備(bei)案其基本情況(kuang)、聯(lian)系人等信(xin)息,并明(ming)確所從(cong)事的主(zhu)要工(gong)種;縣(xian)級住(zhu)房(fang)城鄉(xiang)建(jian)(jian)設部(bu)(bu)門根據備(bei)案信(xin)息核發專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)資質證(zheng)書(shu),專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)在資質證(zheng)書(shu)許可范圍內從(cong)事專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)分(fen)包。切實落(luo)實小微(wei)專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)在增值稅、行政事業(ye)(ye)(ye)(ye)(ye)性收費、政府性基金(jin)等方(fang)面(mian)的減免政策。鼓勵建(jian)(jian)筑(zhu)施(shi)工(gong)承包企業(ye)(ye)(ye)(ye)(ye)與(yu)專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)(ye)建(jian)(jian)立長期穩定(ding)的合作(zuo)(zuo)關(guan)系,不斷提升專(zhuan)業(ye)(ye)(ye)(ye)(ye)作(zuo)(zuo)業(ye)(ye)(ye)(ye)(ye)能力。


    (三)引導勞(lao)(lao)務(wu)企(qi)(qi)(qi)業(ye)轉型(xing)(xing)發(fa)展(zhan)。放寬市場準入限制,鼓勵有一定組織、管理能力的勞(lao)(lao)務(wu)企(qi)(qi)(qi)業(ye)通(tong)過引進人才、設備等途(tu)徑向(xiang)總承包和專(zhuan)(zhuan)業(ye)企(qi)(qi)(qi)業(ye)轉型(xing)(xing);鼓勵大中型(xing)(xing)勞(lao)(lao)務(wu)企(qi)(qi)(qi)業(ye)充分(fen)利用自身(shen)優勢搭(da)建勞(lao)(lao)務(wu)用工平臺,為施工企(qi)(qi)(qi)業(ye)提供合格的建筑工人;引導小微型(xing)(xing)勞(lao)(lao)務(wu)企(qi)(qi)(qi)業(ye)向(xiang)專(zhuan)(zhuan)業(ye)作(zuo)(zuo)業(ye)企(qi)(qi)(qi)業(ye)轉型(xing)(xing)發(fa)展(zhan),做專(zhuan)(zhuan)做精專(zhuan)(zhuan)業(ye)作(zuo)(zuo)業(ye),成為建筑業(ye)用工主體。


    (四)全面推(tui)行實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理。施(shi)工(gong)總承包企業(ye)要建(jian)立建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理制(zhi)(zhi)度,明確管(guan)(guan)(guan)理職責,對進(jin)入施(shi)工(gong)現(xian)場建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)實(shi)(shi)(shi)(shi)行實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理,記錄建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)的身(shen)份信(xin)(xin)(xin)息、培訓情況、職業(ye)技能(neng)、從業(ye)記錄等(deng)信(xin)(xin)(xin)息。要充分(fen)運用物(wu)聯網、生物(wu)識(shi)別(bie)等(deng)信(xin)(xin)(xin)息化(hua)手(shou)段,實(shi)(shi)(shi)(shi)現(xian)信(xin)(xin)(xin)息化(hua)管(guan)(guan)(guan)理。各地要制(zhi)(zhi)定(ding)(ding)建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理辦法,加(jia)強(qiang)監督(du)檢查,建(jian)立地區實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理平(ping)臺,及時采集企業(ye)現(xian)場實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理數(shu)(shu)據。強(qiang)化(hua)實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)數(shu)(shu)據應用,將實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)管(guan)(guan)(guan)理與企業(ye)誠信(xin)(xin)(xin)體(ti)系、市場準(zhun)入、評優評先、欠薪處理等(deng)相結合。建(jian)立全國建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)管(guan)(guan)(guan)理服務信(xin)(xin)(xin)息平(ping)臺,制(zhi)(zhi)定(ding)(ding)數(shu)(shu)據標準(zhun),加(jia)強(qiang)信(xin)(xin)(xin)息互聯共享(xiang)。到2020年實(shi)(shi)(shi)(shi)現(xian)全國建(jian)筑(zhu)(zhu)(zhu)工(gong)人(ren)實(shi)(shi)(shi)(shi)名(ming)(ming)制(zhi)(zhi)全覆蓋。


    三、切實提高建筑工人技能素質


    (五(wu))加強(qiang)(qiang)職(zhi)(zhi)(zhi)業(ye)(ye)(ye)技能培(pei)(pei)(pei)(pei)訓(xun)。建(jian)(jian)立行(xing)(xing)業(ye)(ye)(ye)、企(qi)業(ye)(ye)(ye)、院校、社(she)會(hui)力(li)(li)量共同參與的(de)建(jian)(jian)筑(zhu)(zhu)工人(ren)(ren)職(zhi)(zhi)(zhi)業(ye)(ye)(ye)教育培(pei)(pei)(pei)(pei)訓(xun)體(ti)系(xi)。落(luo)實(shi)企(qi)業(ye)(ye)(ye)建(jian)(jian)筑(zhu)(zhu)工人(ren)(ren)職(zhi)(zhi)(zhi)業(ye)(ye)(ye)培(pei)(pei)(pei)(pei)訓(xun)的(de)主體(ti)責任,引導企(qi)業(ye)(ye)(ye)制(zhi)(zhi)定建(jian)(jian)筑(zhu)(zhu)工人(ren)(ren)培(pei)(pei)(pei)(pei)養計劃和(he)培(pei)(pei)(pei)(pei)訓(xun)制(zhi)(zhi)度(du),優化整合培(pei)(pei)(pei)(pei)訓(xun)資源,充分依(yi)托施工現(xian)場(chang)資源,通過建(jian)(jian)立培(pei)(pei)(pei)(pei)訓(xun)基地、加強(qiang)(qiang)校企(qi)合作、購買社(she)會(hui)培(pei)(pei)(pei)(pei)訓(xun)服務、新型學徒制(zhi)(zhi)等(deng)多種形(xing)式,開展崗前培(pei)(pei)(pei)(pei)訓(xun)和(he)技能提升培(pei)(pei)(pei)(pei)訓(xun)。鼓勵專業(ye)(ye)(ye)培(pei)(pei)(pei)(pei)訓(xun)機構、職(zhi)(zhi)(zhi)業(ye)(ye)(ye)院校(含技工學校)和(he)社(she)會(hui)團(tuan)體(ti)等(deng)力(li)(li)量積(ji)極參與建(jian)(jian)筑(zhu)(zhu)業(ye)(ye)(ye)工人(ren)(ren)職(zhi)(zhi)(zhi)業(ye)(ye)(ye)培(pei)(pei)(pei)(pei)訓(xun),按照市場(chang)化要求(qiu),發(fa)揮優勢和(he)特(te)色,構建(jian)(jian)與企(qi)業(ye)(ye)(ye)培(pei)(pei)(pei)(pei)訓(xun)互為補充的(de)培(pei)(pei)(pei)(pei)訓(xun)網(wang)絡,不(bu)斷擴大行(xing)(xing)業(ye)(ye)(ye)工人(ren)(ren)職(zhi)(zhi)(zhi)業(ye)(ye)(ye)培(pei)(pei)(pei)(pei)訓(xun)全覆蓋面。完(wan)善職(zhi)(zhi)(zhi)業(ye)(ye)(ye)教育制(zhi)(zhi)度(du),根據產業(ye)(ye)(ye)發(fa)展的(de)新要求(qiu)、新技術(shu)、新規范,健全教學標準(zhun)體(ti)系(xi),更新課程內容,指導有關職(zhi)(zhi)(zhi)業(ye)(ye)(ye)院校優化建(jian)(jian)筑(zhu)(zhu)類(lei)專業(ye)(ye)(ye)設置(zhi),結合辦學實(shi)際制(zhi)(zhi)定專業(ye)(ye)(ye)人(ren)(ren)才培(pei)(pei)(pei)(pei)養方案,切實(shi)為培(pei)(pei)(pei)(pei)養行(xing)(xing)業(ye)(ye)(ye)急需人(ren)(ren)才服務。爭(zheng)取到2025年實(shi)現(xian)建(jian)(jian)筑(zhu)(zhu)業(ye)(ye)(ye)工人(ren)(ren)培(pei)(pei)(pei)(pei)訓(xun)全覆蓋。


    (六(liu))完善(shan)建(jian)筑(zhu)業(ye)技(ji)能(neng)(neng)鑒(jian)(jian)定(ding)(ding)(ding)(ding)體系。做好建(jian)筑(zhu)工(gong)(gong)人(ren)相關職業(ye)技(ji)能(neng)(neng)標準和(he)評價規范制定(ding)(ding)(ding)(ding)工(gong)(gong)作(zuo),按照(zhao)國家職業(ye)資格(ge)目錄規定(ding)(ding)(ding)(ding)的職業(ye)工(gong)(gong)種推(tui)動(dong)建(jian)筑(zhu)工(gong)(gong)人(ren)職業(ye)鑒(jian)(jian)定(ding)(ding)(ding)(ding)工(gong)(gong)作(zuo)。創新考培模(mo)式,技(ji)能(neng)(neng)鑒(jian)(jian)定(ding)(ding)(ding)(ding)機構應充分(fen)依(yi)托大中型項目開展技(ji)能(neng)(neng)鑒(jian)(jian)定(ding)(ding)(ding)(ding),將實際工(gong)(gong)程生產(chan)與考核鑒(jian)(jian)定(ding)(ding)(ding)(ding)結合(he)起(qi)來,解決工(gong)(gong)學矛盾,提高鑒(jian)(jian)定(ding)(ding)(ding)(ding)評價的有效性、針對性,降低(di)鑒(jian)(jian)定(ding)(ding)(ding)(ding)場地(di)、器材等(deng)成本。


    (七(qi))建(jian)立技(ji)(ji)能(neng)導向的激勵(li)(li)機制。各地要編制施(shi)工(gong)(gong)現場(chang)(chang)(chang)人(ren)員配備標準(zhun),督促(cu)企(qi)業(ye)強化技(ji)(ji)能(neng)培訓和(he)(he)開展技(ji)(ji)能(neng)鑒定。到(dao)2020年施(shi)工(gong)(gong)現場(chang)(chang)(chang)中級(ji)(ji)工(gong)(gong)以上建(jian)筑工(gong)(gong)人(ren)占比(bi)(bi)不少于(yu)10%,到(dao)2025年施(shi)工(gong)(gong)現場(chang)(chang)(chang)中級(ji)(ji)工(gong)(gong)以上建(jian)筑工(gong)(gong)人(ren)占比(bi)(bi)不少于(yu)30%。加強對現場(chang)(chang)(chang)作業(ye)人(ren)員的技(ji)(ji)能(neng)水(shui)平和(he)(he)配備比(bi)(bi)例監督檢查(cha),要將相關情(qing)況與市場(chang)(chang)(chang)準(zhun)入、招標投標、誠信體系、評價(jia)評優等掛鉤。鼓勵(li)(li)有關部門發布各個(ge)技(ji)(ji)能(neng)等級(ji)(ji)和(he)(he)工(gong)(gong)種的人(ren)工(gong)(gong)成(cheng)本信息,為(wei)企(qi)業(ye)合理(li)確定建(jian)筑工(gong)(gong)人(ren)工(gong)(gong)資提供信息指引,鼓勵(li)(li)企(qi)業(ye)將技(ji)(ji)能(neng)水(shui)平與薪(xin)酬掛鉤。引導企(qi)業(ye)建(jian)立技(ji)(ji)能(neng)人(ren)才專(zhuan)家庫和(he)(he)首席技(ji)(ji)師制度。鼓勵(li)(li)各主管部門、協會、企(qi)業(ye)積極(ji)開展崗(gang)位練(lian)兵、技(ji)(ji)術比(bi)(bi)武、技(ji)(ji)能(neng)競賽。


    四、切實保障建筑工人合法權益


    (八)健全保(bao)障薪酬支(zhi)(zhi)付的(de)(de)長效(xiao)機制(zhi)。要(yao)(yao)(yao)嚴格落實《國務院(yuan)辦公(gong)(gong)廳關于全面治(zhi)理拖(tuo)欠(qian)農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)問(wen)題(ti)的(de)(de)意(yi)見》有關要(yao)(yao)(yao)求(qiu),全面落實施(shi)(shi)工(gong)(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye)(包(bao)(bao)(bao)括直(zhi)(zhi)接承(cheng)(cheng)包(bao)(bao)(bao)建(jian)設單(dan)(dan)位發包(bao)(bao)(bao)工(gong)(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)專業(ye)(ye)(ye)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye),下同)對所(suo)承(cheng)(cheng)包(bao)(bao)(bao)工(gong)(gong)(gong)(gong)程(cheng)(cheng)項(xiang)目的(de)(de)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)人(ren)工(gong)(gong)(gong)(gong)資(zi)支(zhi)(zhi)付負總(zong)責,分包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye)(包(bao)(bao)(bao)括承(cheng)(cheng)包(bao)(bao)(bao)施(shi)(shi)工(gong)(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye)發包(bao)(bao)(bao)工(gong)(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)專業(ye)(ye)(ye)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye)和專業(ye)(ye)(ye)作業(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye))對所(suo)招用的(de)(de)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)人(ren)工(gong)(gong)(gong)(gong)資(zi)支(zhi)(zhi)付直(zhi)(zhi)接負責。推行(xing)工(gong)(gong)(gong)(gong)程(cheng)(cheng)款支(zhi)(zhi)付擔(dan)保(bao)制(zhi)度(du),建(jian)設單(dan)(dan)位要(yao)(yao)(yao)求(qiu)承(cheng)(cheng)包(bao)(bao)(bao)單(dan)(dan)位提供履約保(bao)證(zheng)金(jin)的(de)(de),應向施(shi)(shi)工(gong)(gong)(gong)(gong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)業(ye)(ye)(ye)提供相應的(de)(de)支(zhi)(zhi)付擔(dan)保(bao),采用經濟(ji)手段解決工(gong)(gong)(gong)(gong)程(cheng)(cheng)款支(zhi)(zhi)付不及時(shi)導致拖(tuo)欠(qian)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)人(ren)工(gong)(gong)(gong)(gong)資(zi)問(wen)題(ti)。加快(kuai)完善工(gong)(gong)(gong)(gong)資(zi)保(bao)證(zheng)金(jin)、欠(qian)薪應急周轉金(jin)等(deng)有關制(zhi)度(du),建(jian)立拖(tuo)欠(qian)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)人(ren)工(gong)(gong)(gong)(gong)資(zi)“黑名(ming)單(dan)(dan)”制(zhi)度(du),對存在拖(tuo)欠(qian)工(gong)(gong)(gong)(gong)資(zi)的(de)(de)企(qi)(qi)業(ye)(ye)(ye)列入(ru)“黑名(ming)單(dan)(dan)”,并(bing)(bing)將“黑名(ming)單(dan)(dan)”信(xin)息(xi)通過(guo)“信(xin)用中國”、國家企(qi)(qi)業(ye)(ye)(ye)信(xin)用信(xin)息(xi)公(gong)(gong)示系統予以公(gong)(gong)示,并(bing)(bing)實施(shi)(shi)跨部門聯合懲(cheng)戒(jie),采取限(xian)制(zhi)市場準(zhun)入(ru)等(deng)懲(cheng)戒(jie)措施(shi)(shi),情(qing)節嚴重的(de)(de)降低資(zi)質等(deng)級。


    (九)提高勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)簽訂率(lv)。全面落實(shi)(shi)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制度(du),制定適合(he)(he)建筑業用(yong)工特點的(de)簡(jian)易勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)示范文本,加大勞(lao)(lao)動(dong)(dong)(dong)監察力度(du),督(du)促施(shi)工單位(wei)與招用(yong)的(de)建筑工人依法簽訂書(shu)面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),施(shi)工總承包企業要督(du)促分包企業與其招用(yong)的(de)建筑工人本人簽訂書(shu)面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)。施(shi)工總承包企業要將(jiang)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)信息納(na)入實(shi)(shi)名制管理,嚴禁用(yong)勞(lao)(lao)務分包合(he)(he)同(tong)(tong)(tong)代替勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),杜絕代簽合(he)(he)同(tong)(tong)(tong)。到2020年基本實(shi)(shi)現勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)全覆蓋。


    (十)健全(quan)社(she)會(hui)(hui)保(bao)(bao)險(xian)(xian)繳(jiao)費(fei)機制(zhi)。對不能(neng)按(an)用(yong)(yong)人(ren)(ren)單(dan)位參保(bao)(bao)、建(jian)筑(zhu)項目使用(yong)(yong)的(de)建(jian)筑(zhu)業(ye)(ye)職工(gong)(gong)特(te)別(bie)是農(nong)民工(gong)(gong),按(an)項目參加(jia)工(gong)(gong)傷保(bao)(bao)險(xian)(xian)。合理確(que)定工(gong)(gong)傷保(bao)(bao)險(xian)(xian)費(fei)率,規范和簡化工(gong)(gong)傷認定和勞動(dong)能(neng)力鑒定流程,著力提高工(gong)(gong)傷保(bao)(bao)險(xian)(xian)管(guan)理服務(wu)。加(jia)強監(jian)督檢查(cha),確(que)保(bao)(bao)工(gong)(gong)傷保(bao)(bao)險(xian)(xian)覆蓋施工(gong)(gong)現場所(suo)有建(jian)筑(zhu)工(gong)(gong)人(ren)(ren)。建(jian)立健全(quan)與建(jian)筑(zhu)業(ye)(ye)相適應的(de)社(she)會(hui)(hui)保(bao)(bao)險(xian)(xian)參保(bao)(bao)繳(jiao)費(fei)方式,施工(gong)(gong)企(qi)業(ye)(ye)(包(bao)括專業(ye)(ye)作業(ye)(ye)企(qi)業(ye)(ye))應在勞動(dong)合同的(de)薪酬中列明用(yong)(yong)于建(jian)筑(zhu)工(gong)(gong)人(ren)(ren)參保(bao)(bao)所(suo)需費(fei)用(yong)(yong),依(yi)法為建(jian)筑(zhu)工(gong)(gong)人(ren)(ren)繳(jiao)納社(she)會(hui)(hui)保(bao)(bao)險(xian)(xian)。


    (十(shi)一)改善建(jian)(jian)筑工(gong)(gong)人生(sheng)產生(sheng)活(huo)環境。逐(zhu)步提高施工(gong)(gong)現場(chang)環境與衛生(sheng)標準(zhun),改善勞(lao)動安(an)(an)全(quan)(quan)衛生(sheng)條(tiao)件,按規(gui)定(ding)提供勞(lao)動保(bao)(bao)護用品(pin)。按照(zhao)國家(jia)規(gui)定(ding)進行上崗(gang)前、在崗(gang)期間(jian)和離(li)崗(gang)時的職業(ye)(ye)健康檢查,最大(da)限(xian)度地(di)(di)減少生(sheng)產安(an)(an)全(quan)(quan)事故和職業(ye)(ye)病危害(hai)。加強建(jian)(jian)筑工(gong)(gong)人居(ju)住(zhu)(zhu)地(di)(di)基礎設施建(jian)(jian)設,改善居(ju)住(zhu)(zhu)環境。在有條(tiao)件的地(di)(di)區,探索(suo)建(jian)(jian)設與工(gong)(gong)地(di)(di)分開(kai)的集中(zhong)居(ju)住(zhu)(zhu)基地(di)(di)。地(di)(di)級以上城市要(yao)將符合當地(di)(di)住(zhu)(zhu)房保(bao)(bao)障條(tiao)件的建(jian)(jian)筑工(gong)(gong)人納(na)入(ru)住(zhu)(zhu)房保(bao)(bao)障范圍(wei)。


    五、強化組織實施


    (十二(er))強(qiang)化組織領導。培育(yu)新時期建(jian)筑工(gong)(gong)人隊(dui)伍(wu)(wu)是(shi)促進(jin)建(jian)筑業持續健康發展(zhan)的(de)(de)重(zhong)點任務,涉及(ji)面(mian)廣、政策(ce)(ce)性強(qiang)。各有關部(bu)(bu)門(men)(men)要(yao)充分認識該項工(gong)(gong)作的(de)(de)重(zhong)要(yao)性,強(qiang)化部(bu)(bu)門(men)(men)協(xie)作,建(jian)立建(jian)筑工(gong)(gong)人隊(dui)伍(wu)(wu)培育(yu)的(de)(de)部(bu)(bu)門(men)(men)協(xie)調機制(zhi)。各級住房城鄉建(jian)設(she)主管(guan)部(bu)(bu)門(men)(men)要(yao)會(hui)同(tong)各有關部(bu)(bu)門(men)(men),結(jie)合本地區實際,制(zhi)定培育(yu)建(jian)筑工(gong)(gong)人隊(dui)伍(wu)(wu)的(de)(de)政策(ce)(ce)措施(shi)。及(ji)時研(yan)究和解決工(gong)(gong)作中(zhong)的(de)(de)重(zhong)大問題,充分調動企(qi)業、建(jian)筑工(gong)(gong)人、社(she)會(hui)組織的(de)(de)積極性,形成多方合力(li)、共同(tong)推進(jin)建(jian)筑工(gong)(gong)人隊(dui)伍(wu)(wu)建(jian)設(she)的(de)(de)良好局面(mian)。


    (十(shi)三)加大資金投入和(he)財稅支持。根據(ju)建筑業(ye)(ye)(ye)(ye)特點(dian)和(he)實(shi)際制定(ding)五年和(he)十(shi)年支持建筑業(ye)(ye)(ye)(ye)工(gong)(gong)人(ren)培(pei)(pei)訓(xun)(xun)專(zhuan)項(xiang)資金中長期(qi)規劃。落實(shi)好職(zhi)業(ye)(ye)(ye)(ye)培(pei)(pei)訓(xun)(xun)補(bu)貼(tie)(tie)和(he)執業(ye)(ye)(ye)(ye)技能鑒定(ding)補(bu)貼(tie)(tie)政策,完善技能培(pei)(pei)訓(xun)(xun)補(bu)貼(tie)(tie)機制,對符合條件人(ren)員參加建筑業(ye)(ye)(ye)(ye)職(zhi)業(ye)(ye)(ye)(ye)培(pei)(pei)訓(xun)(xun)及技師、高級技師培(pei)(pei)訓(xun)(xun)的,給予(yu)一定(ding)培(pei)(pei)訓(xun)(xun)補(bu)貼(tie)(tie),對其中通過初次技能鑒定(ding)并取得職(zhi)業(ye)(ye)(ye)(ye)資格(ge)證(zheng)書或專(zhuan)項(xiang)職(zhi)業(ye)(ye)(ye)(ye)能力證(zheng)書的,再給予(yu)一定(ding)技能鑒定(ding)補(bu)貼(tie)(tie)。企業(ye)(ye)(ye)(ye)應(ying)當在(zai)工(gong)(gong)程造(zao)價中明確相關費(fei)用用于工(gong)(gong)人(ren)技能培(pei)(pei)訓(xun)(xun)。


    (十四)營造(zao)良好(hao)(hao)輿(yu)(yu)論環境。堅持(chi)正(zheng)確的(de)(de)輿(yu)(yu)論導(dao)向,大(da)力(li)宣(xuan)(xuan)傳培育建筑工(gong)人(ren)隊伍的(de)(de)重(zhong)大(da)意(yi)義、目(mu)標任務和政策舉措。發揮新聞(wen)媒體宣(xuan)(xuan)傳引(yin)導(dao)和輿(yu)(yu)論監督作用,加大(da)普法(fa)力(li)度,督促企(qi)業(ye)合法(fa)用工(gong),引(yin)導(dao)建筑工(gong)人(ren)合法(fa)反映(ying)訴(su)求。充分利用互(hu)聯(lian)網(wang)、微(wei)博、微(wei)信等現代傳媒手段,積(ji)極宣(xuan)(xuan)傳建筑工(gong)人(ren)的(de)(de)先進典(dian)型,及時總(zong)結和推廣培育建筑工(gong)人(ren)的(de)(de)好(hao)(hao)經驗、好(hao)(hao)做(zuo)法(fa)。不斷(duan)創(chuang)新宣(xuan)(xuan)傳方(fang)式(shi),增(zeng)強宣(xuan)(xuan)傳效果,營造(zao)崇尚勞動、重(zhong)視技能(neng)的(de)(de)良好(hao)(hao)輿(yu)(yu)論氛圍。


    (十五)發揮工(gong)(gong)(gong)(gong)會(hui)組(zu)織和(he)社會(hui)組(zu)織積(ji)極作(zuo)用(yong)(yong)。正確(que)引(yin)導(dao)和(he)鼓勵社會(hui)組(zu)織參(can)與培育建(jian)筑工(gong)(gong)(gong)(gong)人(ren)隊伍工(gong)(gong)(gong)(gong)作(zuo),積(ji)極為建(jian)筑工(gong)(gong)(gong)(gong)人(ren)提(ti)供服(fu)務、反映訴求。鼓勵行業協會(hui)和(he)社會(hui)組(zu)織搭建(jian)施工(gong)(gong)(gong)(gong)專業作(zuo)業用(yong)(yong)工(gong)(gong)(gong)(gong)平(ping)臺(tai),助力小微(wei)專業作(zuo)業企(qi)業發展。積(ji)極發揮工(gong)(gong)(gong)(gong)會(hui)組(zu)織的(de)作(zuo)用(yong)(yong),各級工(gong)(gong)(gong)(gong)會(hui)要加(jia)強基層組(zu)織建(jian)設,不(bu)斷創新機制,通過項目工(gong)(gong)(gong)(gong)會(hui)、托管(guan)工(gong)(gong)(gong)(gong)會(hui)、聯合工(gong)(gong)(gong)(gong)會(hui)等(deng)多(duo)種(zhong)形式(shi),將(jiang)建(jian)筑工(gong)(gong)(gong)(gong)人(ren)納入工(gong)(gong)(gong)(gong)會(hui)組(zu)織,為其(qi)(qi)維護其(qi)(qi)基本權益(yi)提(ti)供依托。
